Sleep Disorders (Non-Apnea) VA Disability Rating

OVERVIEW
Non-apnea sleep disorders include insomnia, hypersomnia, circadian rhythm disorders, parasomnia (nightmares, sleep walking), and narcolepsy. These are most commonly rated as symptoms of an underlying mental health condition under 38 C.F.R. 4.130. Combat-related nightmares are rated as part of PTSD. If a sleep disorder is independently diagnosed (such as narcolepsy), it may be rated under its own diagnostic code. For most veterans, the best strategy is ensuring sleep disruption is fully documented as part of their mental health rating.
RATING CRITERIA (3 LEVELS)
80% -- Narcolepsy with major seizure-like episodes (DC 8108)
If diagnosed with narcolepsy, rated based on frequency of cataplexy/sleep attacks.
50% -- As part of mental health rating under General Rating Formula
Chronic sleep impairment is a listed symptom at the 30-50% mental health rating level.
10% -- Narcolepsy with minor seizure-like episodes (DC 8108)
Infrequent narcoleptic episodes.
KEY EVIDENCE TO GATHER
-Sleep study (polysomnography) documenting sleep architecture disruption
-Mental health records documenting combat nightmares, insomnia, hypervigilance at night
-Prescription records for sleep medications (trazodone, prazosin, zolpidem, suvorexant)
-Buddy/spouse statements describing nighttime behavior (thrashing, screaming, inability to sleep)

C&P EXAM TIPS (4)
1.For most veterans, sleep disorders are best documented as part of PTSD or another mental health condition rather than standalone.
2.If you take prazosin for combat nightmares, this strongly supports both the sleep disruption and PTSD diagnosis.
3.A sleep study provides objective evidence of disrupted sleep architecture even if subjective symptoms are hard to quantify.
4.If you have shift work disorder from military service (rotating shifts, guard duty), document the onset during service.
