Hepatitis C VA Disability Rating

OVERVIEW
Hepatitis C is rated under DC 7354 at 38 C.F.R. § 4.114, which directs evaluation under DC 7345 (Chronic liver disease without cirrhosis). Veterans commonly contract Hepatitis C through military service via air gun vaccinations (jet injectors used through the 1990s), blood transfusions prior to 1992, unsterile medical instruments, or combat injuries. Service connection is established through nexus between military service risk factors and current diagnosis.
RATING CRITERIA (5 LEVELS)
100% — Progressive disease requiring dual therapy
Progressive chronic liver disease requiring both parenteral antiviral therapy (direct antiviral agents) AND parenteral immunomodulatory therapy (interferon). Continues 6 months after discontinuance of treatment.
60% — Progressive with substantial weight loss and 2+ symptoms
Progressive chronic liver disease requiring continuous medication; substantial weight loss; AND at least 2 of: daily fatigue, malaise, anorexia, hepatomegaly, pruritus, arthralgia.
40% — Progressive with minor weight loss and 2+ symptoms
Progressive disease requiring continuous medication; minor weight loss; AND at least 2 of: daily fatigue, malaise, anorexia, hepatomegaly, pruritus, arthralgia.
20% — Symptomatic
Chronic liver disease with at least 1 of: intermittent fatigue, malaise, anorexia, hepatomegaly, or pruritus.
0% — Asymptomatic
Previous history of liver disease, currently asymptomatic.
KEY EVIDENCE TO GATHER
-Positive Hepatitis C antibody test and confirmatory HCV RNA viral load
-Military service records documenting air gun vaccinations (jet injectors)
-Liver function tests (ALT, AST, bilirubin)
-Liver biopsy or FibroScan results showing fibrosis stage
-Treatment records (direct-acting antivirals)
-Documentation of complications: cirrhosis, portal hypertension
-Records of fatigue, weight loss, abdominal pain

DC 7312
Cirrhosis is a direct complication of chronic Hepatitis C — rate separately under DC 7312 if present.
DC 9434
Depression is prevalent in HCV patients and worsened by interferon treatment. Independently ratable.
DC 5003
HCV-related cryoglobulinemia causes arthralgia and arthritis — listed in DC 7345 rating criteria.
DC 7900/7903
Interferon treatment can trigger thyroid autoimmunity.
C&P EXAM TIPS (4)
1.Air gun vaccinations (jet injectors) used through the 1990s are a recognized nexus for HCV. Document this as basis for service connection.
2.Current HCV treatment achieves 95%+ cure rates. Utilize the 100% rating during treatment and the 6-month post-treatment continuation.
3.Even after cure, residual liver damage and cirrhosis remain ratable — file for the residuals.
4.Fatigue, nearly universal in HCV, is a qualifying symptom at the 20% level.

Three-element service connection standard: current disability, in-service incurrence, and nexus. For HCV, air gun vaccination records establish element 2.
