Parkinson's Disease VA Disability Rating

OVERVIEW
Parkinson's Disease (paralysis agitans) is rated under DC 8004 at 38 C.F.R. § 4.124a with a minimum rating of 30%. It is a presumptive condition for veterans with qualifying herbicide (Agent Orange) exposure under 38 C.F.R. § 3.309(e). The VA rates the overall disability picture including tremors, rigidity, bradykinesia, and postural instability. Additional separate ratings may be assigned for residual conditions such as depression, cognitive impairment, and fall-related injuries.
RATING CRITERIA (4 LEVELS)
100% — Total disability
Severe parkinsonism with complete disability. Inability to perform activities of daily living, severe tremor and rigidity, loss of postural stability, dementia, or inability to ambulate without assistance.
70% — Severe involvement
Marked tremors affecting both arms and legs, significant rigidity, severe bradykinesia, postural instability with frequent falls. Unable to maintain employment. Requires significant assistance with ADLs.
50% — Moderate to severe
Moderate tremors, rigidity, and bradykinesia affecting gait and fine motor control. Episodic on/off phenomena despite medication. Significant limitation in occupational function.
30% — Minimum rating (any diagnosis)
Minimum 30% evaluation assigned upon diagnosis of Parkinson's Disease. Per 38 C.F.R. § 4.124a, DC 8004, the minimum schedular evaluation is 30%. Mild tremors, beginning rigidity, early bradykinesia.
KEY EVIDENCE TO GATHER
-Neurologist diagnosis confirming Parkinson's Disease
-Service records documenting herbicide/Agent Orange exposure (AO presumptive — no nexus letter required)
-VA treatment records documenting medication regimen (levodopa, dopamine agonists)
-Functional capacity evaluation documenting tremors, gait, fine motor control
-Records of falls, injuries, or assistive device use
-Neuropsychological testing if cognitive impairment present
-Documentation of on/off medication effects

Depression occurs in 40-60% of Parkinson's patients. Neurochemical changes in the dopaminergic system directly cause depressive symptoms.

REM sleep behavior disorder occurs in 80-90% of Parkinson's patients, often predating motor symptoms by years.

Parkinson's disease dementia occurs in 70-80% of patients over the disease course. Rate separately under DC 9312.

Parkinson's-related motor dysfunction affects swallowing in 80% of patients.

Autonomic dysfunction in Parkinson's causes clinically significant drops in blood pressure upon standing.
C&P EXAM TIPS (6)
1.Parkinson's is a presumptive for Agent Orange exposure — if you served in Vietnam or eligible location, no nexus letter needed.
2.The minimum schedular rating is 30% upon diagnosis — you will not be rated below 30%.
3.Describe tremors at rest (resting tremor is classic Parkinson's), pill-rolling movements, masked face, shuffling gait, and postural instability.
4.Document any falls and fall-related injuries separately.
5.If you have cognitive symptoms, request a neuropsychological evaluation for a separate dementia rating.
6.On/off phenomena (when medication wears off) should be specifically documented.
