Restless Legs Syndrome VA Disability Rating

OVERVIEW
Restless legs syndrome (RLS) is typically rated by analogy under the peripheral nerve conditions at 38 C.F.R. § 4.124a. RLS may be rated under DC 8103 (convulsive tic) or DC 8620 (neuritis of the sciatic nerve) depending on the severity and presentation. RLS is common among veterans with PTSD, TBI, peripheral neuropathy, and those taking certain medications.
RATING CRITERIA (3 LEVELS)
40% -- Severe functional impairment by analogy to peripheral nerve
Rate RLS by analogy to the most closely related peripheral nerve condition. Severe incomplete paralysis of the sciatic nerve (DC 8520) = 40%. Rate based on degree of functional impairment in the affected extremity.
20% -- Moderate functional impairment
Moderate functional impairment from RLS -- significant sleep disturbance, daytime fatigue, and limb discomfort affecting daily activities. Rate by analogy to peripheral nerve codes under 38 C.F.R. 4.124a.
10% -- Mild functional impairment
Mild RLS symptoms causing sleep disruption but manageable with medication. Rate by analogy to the peripheral nerve affecting the primary symptom distribution -- typically sciatic (DC 8520) or common peroneal (DC 8521).

-Sleep study showing periodic limb movements during sleep (PLMS)
-Neurological evaluation documenting RLS diagnosis
-Medication history showing dopaminergic agents or gabapentin for RLS
-Documentation of sleep disruption and daytime fatigue from RLS

Chronic sleep deprivation from RLS causes secondary mental health conditions.
C&P EXAM TIPS (3)
1.RLS is often secondary to peripheral neuropathy, iron deficiency from medications, or PTSD medications.
2.Document the impact on sleep: how many hours of sleep you lose, how many times you wake per night.
3.If taking medication for RLS, document what you take and whether it adequately controls symptoms.

Restless legs syndrome has no specific diagnostic code. Under 4.20, rate by analogy to the peripheral nerve condition most closely related to the functional impairment.
DOLLAR IMPACT
