Prostate Conditions VA Disability Rating

OVERVIEW
Prostate conditions include benign prostatic hyperplasia (BPH, DC 7527) and prostate cancer (DC 7528). Prostate cancer is presumptive for Agent Orange-exposed veterans under 38 C.F.R. 3.309(e). Prostate conditions are rated based on voiding dysfunction (frequency, obstruction, incontinence) or as an active malignancy (100% during active treatment). After treatment, the rating is based on residual voiding dysfunction or renal dysfunction.
RATING CRITERIA (4 LEVELS)
100% -- Active malignancy or during antineoplastic treatment
Prostate cancer rated at 100% during active treatment. Six months after cessation of treatment, rated on residuals.
60% -- Voiding dysfunction requiring absorbent materials changed more than 4 times per day
Severe urinary incontinence after prostate surgery or treatment.
40% -- Voiding dysfunction requiring absorbent materials changed 2-4 times per day, or daytime voiding interval less than 1 hour, or awakening 5+ times per night
Significant urinary frequency or incontinence.
20% -- Daytime voiding interval 1-2 hours, or awakening 3-4 times per night
Moderate urinary frequency.
KEY EVIDENCE TO GATHER
-Prostate biopsy results (for cancer)
-PSA testing history
-DD-214 showing Vietnam/Agent Orange service (for presumptive cancer claims)
-Urology records documenting symptoms and treatment
-Documentation of voiding frequency, incontinence pad usage, and nocturnal awakenings

C&P EXAM TIPS (4)
1.If you served in Vietnam and have prostate cancer, it is PRESUMPTIVE under Agent Orange regulations. No nexus needed.
2.During active cancer treatment, the rating is 100%. File immediately upon diagnosis.
3.After treatment, keep a voiding diary: how many times you urinate per day, per night, and how many pads you use.
4.ED after prostate treatment qualifies for SMC-K ($139.87/mo) even at 0% rating.
