Common mistakes
- ×Omitting the VA File Number - the supplement gets processed as a standalone new claim instead of attaching to the legacy docket.
- ×Mismatched name or SSN - intake flags it as a different claimant.
Section II - New or Additional Conditions

List every new condition you are adding, or existing conditions you are supplementing with new evidence. For each, note whether it is a new initial claim, an increase, or a secondary condition. Under the legacy "new and material" standard, you need evidence that is both new (not previously submitted) and material (directly relevant to the claim).
e.g., 1. Tinnitus (new claim - not previously filed) 2. Radiculopathy left leg (secondary to lumbar DDD already on file) 3. PTSD (increase - new psychiatrist evaluation showing 70% level)
Common mistakes
- ×Submitting evidence under 21-526b that does not meet the "new and material" standard under the legacy rules - this is a higher bar than the AMA "new and relevant" standard in 20-0995.
- ×Not specifying whether each condition is new, an increase, or secondary - VA may misroute the claim.
- ×Filing 21-526b when your decision is post-2/19/2019 - use 20-0995 instead.

Section III - New and Material Evidence

Describe each piece of new evidence and explain why it is material to the claim. Under the legacy standard, evidence is "material" if it would change the outcome of the claim. Simply submitting the same type of evidence again (e.g., another negative exam) may not qualify.
e.g., New MRI dated 01/10/2026 showing L4-L5 herniation with nerve impingement not present in prior imaging. Material because prior denial was based on absence of objective findings.
Common mistakes
- ×Submitting records already in the file as "new" evidence - VA will note they were already considered.
- ×Not explaining why the evidence is material, just attaching records - the rater needs you to connect the dots.
